"When Taylor Swift began re-recording her old albums and releasing the new, improved “Taylor’s Version,” she did more than delight a nation of Swifties. She also opened significant questions about the role of intellectual property in contract law, and possibly tipped the balance toward artists.

According to Gary R. Greenstein, a technology transactions partner at Wilson Sonsini, the Swift affair is one of many that makes these times especially interesting for copyright law. Greenstein’s current practice focuses on intellectual property, licensing, and commercial transactions, with specialized expertise in the digital exploitation of intellectual property. He appeared at Harvard Law School on March 28 for a lunchtime talk, which was presented and introduced by Chris Bavitz, the WilmerHale Clinical Professor of Law and managing director of the law school’s Cyberlaw Clinic. “I have been doing this for 28 years now and there is never a dull moment,” Greenstein said.

Greenstein placed the Swift story in the larger context of music copyrights. In music, he explained, there are always two copyrights. The first is for the musical work itself, and this is usually controlled by the composer/songwriter, or by a publishing company acting on their behalf. The second is the “master,” the recorded performance of the work, and this is usually controlled by the label."

"Billie Eilish and Nicki Minaj are among 200 artists calling for the "predatory" use of artificial intelligence (AI) in the music industry to be stopped.

In an open letter also signed by Katy Perry and the estate of Frank Sinatra, they warn AI "will set in motion a race to the bottom" if left unchecked...

Other artists have since spoken out about it, with Sting telling the BBC he believes musicians face "a battle" to defend their work against the rise of songs written by AI.

"The building blocks of music belong to us, to human beings," he said.

But not all musicians oppose developments in or use of AI across the music industry, and electronic artist Grimes and DJ David Guetta are among those backing the use of such AI tools."

"How much power do artists actually have in this scenario? It depends on the circumstances, says Ben Depoorter, a professor at University of California Law San Francisco. In the US, licensing companies including Ascap and BMI manage copyright issues on behalf of artists. Generally, venues like convention centers have their own licenses with these companies, meaning that, broadly speaking, the venues can play whatever they want.

However, the rules are a little different when a third party is involved. When a candidate “walks on and they play music, that is actually not covered by the standard license of the venue”, Depoorter says. Political campaigns often don’t realize that they need their own music licenses, under which musicians can opt out of having their music played. “When these authors are saying, ‘Hey, I don’t want him to play my music any more,’ it’s actually a legal right they have,” Depoorter explains."

But the biggest player in this future isn’t one of the names most associated with streaming — Spotify, Amazon, Pandora or Apple. It’s YouTube, the site best known for viral videos, which accounts for 25 percent of all music streamed worldwide, far more than any other site.

Now, YouTube is locked in an increasingly bitter battle with music labels over how much it pays to stream their songs — and at stake is not just the finances of the music industry but also the way that millions of people around the world have grown accustomed to listening to music: free of cost."

Now though, music experts have told the Victoria Derbyshire programme that artists are being advised not to mention publicly who has inspired them.
This is because of a high-profile copyright infringement case in which US jurors ruled that Robin Thicke and Pharrell Williams, on their song Blurred Lines, had copied Marvin Gaye's Got To Give It Up."

"The fight over the Digital Millennium Copyright Act has touched a nerve. The music industry is bracing for what may be a high-wattage lobbying battle reminiscent of the one over the Stop Online Piracy Act, a bill that was abandoned in 2012 after opposition from technology activists and Internet giants like Google and Wikipedia.
The copyright law gives “safe harbor” to Internet service providers that host third-party material. While music groups criticize the law, some legal scholars and policy specialists say any change to it would need to be considered carefully, particularly to preserve protections like fair use.
“Anything that rewrites the D.M.C.A. isn’t just going to affect YouTube,” said James Grimmelmann, a law professor at the University of Maryland. “It is going to affect blogs. It is going to affect fan sites. It is going to affect places for game creators and documentarians and all kinds of others.”
In December, the United States Copyright Office asked for comments about D.M.C.A. as part of a review of the law, and filings by record companies show how laborious copyright policing can be."

"The complex issue of copyright reform took center stage during the Grammy Awards telecast on Feb. 8 when Recording Academy chief Neil Portnow urged Congress to ensure that "new technology [pays] artists fairly." His comments echoed some of the contents of a 250-page music-licensing report issued just three days earlier by the U.S. Copyright Office. Congress may or may not enact some of those recommendations into law -- but if it does, the ramifications are enormous."

"If stereotypes held true, you would think that the Republicans would be the ones telling folks to turn that blasted music down. But this year -- and indeed in many past election cycles -- it's the GOP that has been attracting cease-and-desist letters for pilfering music against the artists' wishes. So let's take a look at some of the more notable GOP music fails from this cycle, and cycles past.

Senate candidate Chuck DeVore (R-CA) got burned for using for using altered-lyric version of Don Henley's "The Boys of Summer" and "All She Wants To Do Is Dance" for his campaign's Web ads. David Byrne is suing Gov. Charlie Crist (I-FL) for using "Road To Nowhere" in a Web ad during his previous Republican Senate primary fight, and of course, as we reported yesterday, Rush cut to the chase and told Senate nominee Rand Paul (R-KY) to stop playing "Tom Sawyer" and "The Spirit of Radio."

The Orleans song "Still The One" has a special place in politics as it has been used not once without the band's permission, but twice -- and the first instance contributed to its author's entrance into national politics. In 2004, the Bush campaign used the song at a rally. As the song's main author, John Hall, told MSNBC in 2008: "George Bush was busy campaigning on an 'ownership society,' yet never asked me, the band, or the publishers for permission." Hall and other stakeholders in the song quickly sent a cease-and-desist letter, and the Bush campaign dropped the song."
