"The U.S. Copyright Office is extending the deadline to submit reply comments in response to the Office’s August 30, 2023, notice of inquiry regarding artificial intelligence and copyright. The deadline will ensure that members of the public have sufficient time to prepare responses to the Office’s questions and submitted comments and that the Office can proceed on a timely basis with its inquiry of the issues identified in its notice with the benefit of a complete record.

Reply comments are now due by 11:59 p.m. eastern time on Wednesday, December 6, 2023.

The Federal Register notice announcing this extension and additional information, including instructions for submitting comments, are available on the  Artificial Intelligence Study webpage."

U.S. Copyright Office ; Copyright Office Issues Notice of Inquiry on Copyright and Artificial Intelligence

"Today, the U.S. Copyright Office issued a notice of inquiry (NOI) in the Federal Register on copyright and artificial intelligence (AI). The Office is undertaking a study of the copyright law and policy issues raised by generative AI and is assessing whether legislative or regulatory steps are warranted. The Office will use the record it assembles to advise Congress; inform its regulatory work; and offer information and resources to the public, courts, and other government entities considering these issues.

The NOI seeks factual information and views on a number of copyright issues raised by recent advances in generative AI. These issues include the use of copyrighted works to train AI models, the appropriate levels of transparency and disclosure with respect to the use of copyrighted works, the legal status of AI-generated outputs, and the appropriate treatment of AI-generated outputs that mimic personal attributes of human artists.

The NOI is an integral next step for the Office’s AI initiative, which was launched in early 2023. So far this year, the Office has held four public listening sessions and two webinars. This NOI builds on the feedback and questions the Office has received so far and seeks public input from the broadest audience to date in the initiative.

“We launched this initiative at the beginning of the year to focus on the increasingly complex issues raised by generative AI. This NOI and the public comments we will receive represent a critical next step,” said Shira Perlmutter, Register of Copyrights and Director of the U.S. Copyright Office. “We look forward to continuing to examine these issues of vital importance to the evolution of technology and the future of human creativity.”

Initial written comments are due by 11:59 p.m. eastern time on Wednesday, October 18, 2023. Reply comments are due by 11:59 p.m. eastern time on Wednesday, November 15, 2023. Instructions for submitting comments are available on the Office’s website. Commenters may choose which and how many questions to respond to in the NOI.

We Want a Copyright Office that Serves the Public

"The Copyright Office, and those who lead it, should serve the public as a whole, not just major media and entertainment companies. That’s what we told the leadership of the House Judiciary Committee this week. If Congress restructures the Copyright Office, it has to put in safeguards against the agency becoming nothing more than a cheerleader for large corporate copyright holders...

We’re pleased to see both the Librarian of Congress and the House Judiciary Committee reaching out beyond the traditional players in copyright policymaking, to seek public input on decisions that impact everyone. But that’s just the first step – we need to make sure they’re giving the public’s feedback adequate consideration and that their final decisions represent the interests of everyone. We’ll be watching what they do, and speaking up to make sure that the interests of the public – including Internet and technology users, consumers, and independent creators – are protected."

[Post-Public Draft 2016-2020 Strategic Plan] Positioning the United States Copyright Office for the Future: Strategic Plan 2016-2020:
[Excerpt]"This Strategic Plan organizes and prioritizes objectives for the next five years. It draws on four years of internal evaluations and public input — that is, two initial years of fact-findings, public inquiries, and special projects, and two additional years of public roundtables, reports, and Congressional hearings. These initiatives, announced in October 2011, coincided with government-mandated budget cuts as well as staff reductions and backlogs. We seized these challenges, however, as an opportunity to examine inefficiencies, dismantle dated practices, and propose new paradigms. Much of this exciting work and our accomplishments to date are described in the back of this Plan. We also introduce here a revised mission statement that better captures our statutory mandate.
Here is my vision for a modern Copyright Office:
Customers should be able to transact with the Office easily, quickly, and from anywhere at any time, using mobile technologies and any number of consumer-friendly platforms and devices to secure rights or access data. They should have at their fingertips an integrated life-cycle of copyright information — not only the date on which a work was created, published or fell into the public domain, but also all of the authors, owners, licensees, derivative uses, rights, and permission information that are both relevant to the marketplace and invaluable to meaningful research. The Office should have businessto-business capabilities that both leverage and support private sector activities, while ensuring and facilitating transparency and fairness.
Although technology improvements are an essential part of the future, true modernization involves much more than making incremental upgrades to hardware or software. It requires re-envisioning almost all of the Copyright Office’s services, including how customers register claims, submit deposits, record documents, share data, and access expert resources, and it requires meeting the diverse needs of individual authors, entrepreneurs, the user community, and the general public.
