"By making eliminating material flagged by Content ID so easy—just click here!—and making challenging matches so perilous, YouTube has put its thumb on the scale against fair use and in favor of copyright abuse. That thumb gets especially heavy given how few real alternatives to YouTube exist.

Hosting creative content should mean a robust commitment to fair use. Fair use enriches our culture and our understanding of it. It is what ensures that copyright doesn’t strangle free expression and creativity. Subtle reinforcement of anti-fair use ideas enacted by private companies, done by the largest players in the ecosystem, does real damage."

"During his announcement on Tuesday, Rand Paul entered and left to the song, "Shuttin' Detroit Down," as Business Insider notes. The song is a twangy lament about the state of the economy that dates back a few years; the copyright stamp on the YouTube video reads "(c) 2009 WMG." WMG, of course, is Warner Music Group.
We've reached out to both WMG and YouTube for comment, and will update this article when we hear back. But it's hard not to see some humor in the situation. Rand Paul's spirited cry against government intervention has been blocked from view because YouTube lets huge music companies preemptively apply copyright law.
Looks like Paul just got another plank in his campaign platform."

"YouTube has paid out a cool $1 billion to copyright holders since 2007, the company confirmed to NBC News. It's all part of YouTube's Content ID program, which, according to a Google spokesperson, scans 400 years' worth of content every single day for potential copyright issues...
The majority of Content ID's 500-plus partners decide to monetize instead of ban those videos, according to Google, which could explain why the entertainment industry shifted from complaining about YouTube to awarding it a Primetime Engineering Emmy Award in 2013."

While the company has still mostly remained mute over its recent policy change, which resulted in a ton of bogus ContentID claims, an even worse problem is that ContentID does serious harm to fair use and public domain videos. The latest example of this comes from Adam Manley, who recently posted a nice video about the month of December and how awesome it is. The second half of the video has him singing the famous song "Silent Night." "Silent Night" was composed in 1818. It is, without question, in the public domain. There is no question about this at all. Adam's rendition of the song is him singing it alone (so not using anyone else's recording). There is simply no question at all that what he did does not violate anyone's copyright. At all. So, what happened? YouTube's ContentID told him that he received not one, not two, but three separate copyright claims on the video, from three of the largest music publishers in the world -- basically all of the publishing arms of the major labels."
