"...no plagiarist can excuse the wrong by showing how much of his work he did not pirate.” These words were written by Judge Learned Hand in 1936. His point was that a taking of someone else’s expression will not be excused merely because it is insubstantial in quantity when held up for comparison to the infringing work.

Years back a copyright defendant client related copyright lore as a defense to his actions. He swore up and down that copying was permissible as long as not more than 10 percent of the source work was taken. Many times that belief has been mistakenly repeated. Many of the older, bedrock, principles of copyright practice are worth repeating. Perhaps this repetition comes from being the teacher that I suspect is part of my DNA.

The “ancient” case of Harper & Row Publishers, Inc. v. Nation Enterprises, 471 U.S. 539 (1985) should absolutely disabuse anyone of this silly notion."

"People often hear similarities between songs when no copying has occurred, Mr. Bennett says. That should not be a surprise. Most songwriters follow a strict set of rules — songs being three to four minutes long or having four beats to a bar — so there is actually much scope for similarity. But the truth is that many songwriters do use other people’s music for inspiration.
“Society’s become enamored by the romantic myth of creativity,” he says. “The idea that inspiration comes to us in a genius-like way from God or the spirit or whatever. Often for songwriters, that is how it feels emotionally. But, of course, every songwriter is partly a product of their influences. Allowing yourself to be influenced by a song — just not copying the melody, chords or lyrics — is perfectly fine. I mean, isn’t that what songwriting actually is?”
Mr. Oxendale agrees. “A lot of famous songs have been created using reference tracks and there’s nothing wrong with that,” he says. “There would be no Beethoven without Haydn. Who would want to have lost his music?”"

"On the YouTube page for “The Snow and Ice Dance,” one of 10 official songs of the Games, many of the comments were in Chinese, although it was not clear how many of them came from the mainland, where an official ban on the site makes access difficult...
Caijing Online, the website of a prominent Chinese business magazine, also noted the similarities, and offered a technical analysis that went beyond the melodic parallels. Among the main points: Both songs employ a piano as the major instrument, have similar prelude chords and an eight-beat introduction, and they run at almost exactly the same tempo...
Accusations of plagiarism and other forms of intellectual property theft are not new in China, where the legal concepts of trademarks and copyrights are not rigorously enforced and remain a source of tension between China and the United States.
Just last month a dispute erupted over a Chinese animated film, “The Autobots,” in which the characters look remarkably like those in “Cars,” produced by Disney’s Pixar Animation Studios. Viewers called “The Autobots” a shameless copy, but the film’s director said he had never even seen “Cars.”"
